General Terms and Conditions

for journeys with trains of Bahnwelt Darmstadt-Kranichstein
1. Operational management

All trips are operated by Bahnwelt Betriebs GmbH, Steinstraße 7, 64291 Darmstadt.

2. Online ticket order

Ordering a ticket via our online shop is binding for you. If, in the case of larger trips it is subject to cancelation due to lack of cost coverage, we will announce a deadline on the event page of such trips by which the costs must be covered. If this is not the case by the deadline and we therefore have to cancel the trip, we will announce this on the event page. In this case, your order will be obsolete.

As soon as it is certain that the trip will take place, we will send you an invoice for the ticket(s) you have ordered by e-mail. Upon receipt of the invoice, a contract of carriage is concluded.

Please pay the invoice in good time before the start of the journey so that we can still send you the ticket(s) by e-mail. If your payment is not credited at least one day before the day of travel, you can either bring proof of payment with you on the journey or, exceptionally, pay the invoice on the train. In the event of a double payment, we will of course refund the overpaid fare. Please also note any special payment instructions on the respective event page.

3. Buying tickets on the train

The following provisions apply accordingly to the purchase of tickets on or in the train. Payment by debit or credit card is not possible on our special trains for technical reasons.

4. Cancellation of the trip

If the journey should become considerably more difficult or impossible for reasons for which we are not responsible (e.g. route closures, strike, force majeure), we are entitled to cancel the journey. In this case, we will reimburse you for the price of the tickets paid for this journey.

5. Departure

We ask DB Netz AG in good time for the (departure) times of our trains at the stations of the trip. As our trains have to fit into the existing rail traffic setup, we are often informed of the final journey times at short notice before the journey. Therefore, please check our respective event page the day before the journey to see if there have been any changes to the journey times.

6. Behaviour during the journey

Passengers are obliged to follow the instructions of our staff. These instructions are for your safety. Boarding and deboarding is always at your own risk and outside fixed platforms only with explecit permission. There is no conveyance obligation. We are entitled to expel from the train any person whose behaviour endangers operational safety or harasses other passengers, without reimbursement of the travel costs.

7. Accessibility - for people with a disability

Due to the historic design (high entrances, narrow doors and passages) of our vehicles, accessibility for people with a disability is not guaranteed. The decision  whether somebody can be taken along takes the conductor. If it is not possible for a person to be taken along, we will refund the fare paid, even for an accompanying person. We recommend to contact us by e-mail in advance (info@bahnwelt.de) whether a transport is possible.

8. Liability

Steam locomotives inevitably develop soot, steam and flying sparks. We can therefore accept no liability for any damage to property or personal injury caused as a result.

In the event of the failure of a historic vehicle, we will try to find an equivalent replacement. If a planned steam locomotive cannot be used due to e.g. the risk of forest fires, we will try to carry out the journey with electric or diesel traction. There is no legal claim to the use of a particular vehicle. If the trip is cancelled completely, we will refund the fare paid. If, in exceptional cases, a window cannot be opened or a toilet is closed in our historic carriages, we ask for your understanding; such disturbances do not entitle to reduce the fare.

In all other respects, we are liable for damage to property only in the event of intent or gross negligence. Liability for damage to property is limited to the amount of three times the price of the ticket purchased. Otherwise, we shall be liable for personal injury or in the event of a breach of a material contractual obligation, but in this case only for the typical, foreseeable damage. Any further liability is excluded. Any liability is excluded for accidents caused by the passenger himself/herself.
